There have been so many legal changes that have happened by executive order in this country these past 4 years. For instance, Executive orders have been signed into law as of October 15, 2012, that give the President of the United States of America the power to control our military forces, the water and food supply, transportation and manufacturing, oil and weapon reserves, and many other resources that are important to the American economy.

Sometimes the flow of change gets hidden among all the rest of life that captures our attention.

A similar law that was passed was that the President would have the authority to command the military to incarcerate Americans without their right for legal counsel respected or the right to have due legal process, for up to 9 months. Our military bases can be used now against American civilians? Will our military actually turn on civilians?

FHA Inspection Disclosures – do the real estate agents involved in a transaction have to provide this disclosure to the buyers? What about during the short sale process? What is the real estate agents scope of obligation?

Who is actually responsible in making sure that the buyer gets an FHA Inspection Disclosure notice?

*It is the lenders legal obligation to make sure the buyer receives the FHA Inspection disclosure notice*

It is the lender’s legal requirement to make sure the buyer receives the notice in a timely manner. The Real estate brokers involved in the transaction, however, need to be aware of and insure that timely execution of the disclosure to the buyer has been made and responded to, in order to avoid any possible chance of having to redo the contract with new signatures and dates.

The buyers should receive the FHA form that says: “For Your Protection: Get a Home Inspection.” The FHA Inspection Disclosure notice form is part of HUD’s awareness program to inform and protect would be home buyers purchasing a home with an FHA loan.

The  FHA Inspection disclosure clearly outlines to the Buyers, that:

• The Federal Housing Authority does not guarantee any value placed on the home
• The FHA does not guarantee the condition of the home
• An appraisal should not be mistaken for a home inspection
• The Buyer has the legal right to get a home inspection

FHA introduced the FHA Inspection disclosure notice in order to reduce its liability and to insure the loan. The revised FHA Inspection Disclosure should be signed for all transactions involving FHA mortgage insurance on a home.

The real estate broker has no legal responsibility to ensure that the disclosure was given and executed. Regardless of the broker’s responsibility, it is in everyone’s best interest to ensure that buyers receive and execute the FHA inspection disclosure in a timely manner prior to mutual execution of the contract.

The FHA has been aggressive in its language within the body of the form to make sure that it is understood by all parties to the transaction, that the disclosure be signed BEFORE  the mutual execution of the contract.

It should be mutually agreeable to everyone in  making sure that the FHA Inspection Disclosure is received by the buyers before a contract is written.

Will 2012 be remembered as the “year of the rebound” in real estate with an official Economic Recovery on the horizon?

Thirty eight of the USA real estate economists from the Urban Land Center for Capital Markets have stepped up to present a semi-annual survey that has some interesting projections to share:

• Home prices are expected to rise in 2013 – with 2014 prices rising significantly
• New Housing starts are expected to nearly double
• Home price declines will stop in the second quarter of 2012
• Home prices are expected to increase 2% in 2013
• Home prices are expected to increase 3.5% in 2014
• Office, retail and industrial properties will have less vacancy rates
• Hotel Occupancy rates will rise
• Rents will increase for all property types in 2012 from .8% for retail and 5% for apartments
• Real GDP is expected to rise from 2.5% this year to 3% in 2012 – and continue to rise to 3.2% by 2014
• The unemployment rate is expected to decrease to 6.9% by 2014

Will 2012 be remembered as the year that economic recovery on the horizon was clearly visible in the real estate industry or are these projections overshadowed by the still imminent crisis happening overseas?

This semi annual report is a consensus view reflecting the median forecast for over 26 economic indicators. These strong projections also predict higher inflation, and of course, higher interest rates.

The semi-annual report does caution that these positive projections could still be negatively impacted by the continuing saga of the European debt crisis, the upcoming presidential election, overseas elections, and the ongoing tighter financial regulations abroad and in the USA – not to mention the foreclosure shadow inventory still left to be dealt with.

The report strongly suggests that 2012 could be the year that marks the beginning of an upswing in housing and real estate that will last til 2015 for the industry.

Will 2012 be remembered as the year that the Economic Recovery on the horizon was first seen or will it be remembered as the year all the brilliant minds of the century got it wrong so all we saw was economic bust, as we hit the debt wall?

The 30 year fixed mortgage rate slid back below 4% this past week, hovering at an historic low level that should cause some heads to turn. 30 year fixed mortgages began around the 1950 era and last month this loan product fell to 3.87%.

Wow! What is holding you back from buying a Denver home right now?

The 15 year fixed rate mortgage product also slid to 3.23%.

The 5 year ARM came down to 2.90%.

Rates this low should prove to be a major influence in refinancing and home purchases according to all the experts. Builders are confident that the market will pick up. Employers appear, from the media reported numbers, to be adding jobs which has reduced the unemployment crisis a bit.

But home prices continue to fall  across the nation, except for a handful of cities like Denver. FICO scores required by lenders still remain at restrictive levels of 620 or higher in order to be considered for a loan. Millions of foreclosures and short sale homes remain on the market in such wretched shape (and unable to appraise at what the lenders want for them) that it is doubtful that even the top producing Realtors could move them. Many would be home owners have fico scores so low from losing their jobs that they can barely be qualified to rent. Best Buy, among others are closing stores and laying off employees.

If the economy is improving so much, why are we not seeing the housing recovery take off?

Why are lenders making it so difficult to get a home loan?

Why are people so hesitant and fearful of losing their jobs?

Foreclosure reviews are under way in earnest – the OCC has attempted to contact over 4 million homeowners whose eligibility for review had already been predetermined. Contact had been initiated by direct mail to those who have been identified as borrowers who might have suffered financial damage as a direct result of Servicer processing. The letters went out  December of 2011. But finding the homeowners who have been displaced as a result of foreclosure has rendered about 5% of the letters undelivered.

The OCC is actively in process of reviewing over 750,000 loans at this time.

Foreclosure reviews under way

Homeowners may request a foreclosure review if they feel that they were financially harmed by their servicers while in the process of foreclosure. Homeowners can go to www.IndependentForeclosureReview.com to make a request for foreclosure review.

Improper fees, incorrectly calculated mortgage payments, improperly processed payments and loan modification problems are the grievances being expressed on the Foreclosure site as of this date.

Should the independent foreclosure review investigation reveal that the homeowner was financially damaged due to servicer actions – the servicer may be required to reimburse lost equity, provide expense repayment with interest, or have the option of repealing the foreclosure.

The OCC has indicated that there are no limits or caps to the amount of compensation a homeowner can receive but there will be a framework created to make sure that recommendations for any compensation are consistent for all servicers.

Angel Realty, LLC wants to encourage any homeowner who feels that they were wronged by their servicer to go to the link noted above as soon as possible to have their foreclosure reviewed by the OCC.

Now that Foreclosure reviews are under way and there is a process in place for homeowner relief – we should start to see more accountability come into play.

The Obama new FHA Streamline refinance plan does appear to address and eliminate a lot of the issues homeowner’s have faced these past 4 years of ever increasing short sales and foreclosures.

Americans have had 4 long, arduous years of high unemployment, severe credit crisis, personal and business bankruptcy, loss of home ownership through the short sale process and foreclosures – with the rising threat of another 4 million foreclosures looming on the horizon. This was, indeed, quite the change – but not the hope that most Americans were looking for.

Allegedly, there are over 3.5 million homeowners that fall into the qualifications and can take advantage of the program details. If lenders cooperate and individuals can actually receive this streamline refinance – it could mean offsetting the implications of another 4 million foreclosures on the economic landscape.

FHA Streamline Refinance Details:

• Effective June 11th, 2012
• Qualifying homeowners must be current on their payment
• The new lender is not required to verify the homeowner’s income
• The new lender is not required to verify the homeowner’s employment
• The new lender is not required to verify the homeowner’s credit score
• Homeowners FHA loan must exist mortgage before May 31, 2009
• The new lender is not required to have an appraisal

If this new FHA streamline refinance program is successful – we should realize a faster housing recovery. We are fast approaching another choice to change the future – let’s hope that this time the choices we make will be for the better. Otherwise, we might see the future of home ownership disappear in America altogether.

So many homeowners in America have suffered tremendous losses over the past 4 years.  Over 22 million homeowners in America are underwater today.We all have looked back and asked the big question: Why? Part of the problem has been lender fraud – especially with unscrupulous mortgage brokers/originators.

Professionals in the housing industry have always advocated education on home building, inspecting and location to protect a homeowner’s interests – and the banks who hold their notes. Education in lender processes have not been emphasized as much as they could have been, in the past.

Freddie Mac (secondary mortgage company) has revised its communications to mortgage loan servicers  to clearly indicate that it isn’t going to go after deficiency judgments for borrowers after they have had to participate in a short sale or deed-in-lieu of foreclosure  – but only if the transaction was processed in accordance with the company’s short sale guidelines.
